(1) These General Terms and Conditions apply to contracts for the rental of holiday flats for accommodation as well as to all further services and deliveries of Villa Alliopi rendered to the Guest. The services of Alliopi are exclusively based on these General Terms and Conditions.
(2) The subletting or re-letting of the rented holiday flat as well as its use for other than residential purposes requires our prior written consent.
(3) The guest's terms and conditions shall only apply if they have been agreed in advance. Deviations from these terms and conditions are only effective if we have expressly confirmed this in writing.
§ 1 Definitions
a) The term "Villa Alliopi", "we", "us" or "our" refers to Villa Alliopi.
b) The term " Villa Alliopi" refers to our website https://villa@alliopi.com
c) The term "Services" refers to all services provided by Villa Alliopi from time to time, including but not limited to receiving booking information through our booking and payment system, managing reservations and payments and responding to customer enquiries through our reservation system and managing content on third party channels through our Channel Manager.
d) The term "Content" means text, graphics, images, music, software, audio, video, information or any other form of data.
e) The term "Customer Content" means content provided by the Customer in the course of using the Services, including but not limited to other information.
§ 2 Booking / Booking Confirmation
All booking requests must be made via our website www.villa-alliopi.com, email alliopi.com. All enquiries made via any other method such as (facebook) will not be considered. If we can offer you the villa in your requested period, we will send you a written confirmation and the invoice by e-mail. Upon receipt of the booking confirmation, as well as after payment has been made (see § 3 Terms of Payment), your booking is legally binding.
§ 3 Terms of payment
Your booking becomes valid upon receipt of payment. Payment in the amount of the rental contract is due immediately after receipt of the booking documents. If the payment deadlines are not met, Villa Alliopi can withdraw from the contract. Non-payment is considered as withdrawal and entitles to re-letting. Additional costs for basic cleaning, energy costs, water, car parking space, waste are not charged.
§ 4 Arrival and departure
On the day of arrival the holiday flat is available from 14:00 hrs. The guest will receive information about the handing over of the keys by e-mail 7 days before arrival. Claims for damages cannot be asserted if the villa can exceptionally not be occupied punctually at 14:00 hrs. On the day of departure, the villa must be vacated by 10:00 am. If the guest wishes to depart late, this should be arranged with us in advance. A late departure without prior arrangement will be charged. A (pro rata) refund of the rent due to early departure will not be made as a matter of principle. The flat must be left swept clean on the day of departure. The dishes, glasses, etc. must be cleaned and put away, the rubbish bins emptied and the refrigerator cleared out. If the flat is not left as desired, you may be charged for this.
§ 5 Villa
The villa will be handed over by us in a tidy and clean condition with a complete inventory. Should you notice any deficiencies during your stay, the guest is obliged to inform Villa Alliopi immediately. The guest is liable for any damage caused by him to the rented property, the inventory, e.g. broken crockery, damage to the floor or furniture. This also includes the costs for lost keys. The inventory is to be treated carefully and with care and is only intended to remain in the villa. The moving of furnishings, especially beds, is prohibited. The guest is also liable for the fault of his fellow travellers. Damage caused by force majeure is excluded from this. In the event of use of the villa contrary to the terms of the contract, such as subletting, overcrowding, disturbance of domestic peace, etc., the contract may be terminated without notice and the guest must therefore leave the villa immediately. The rent already paid remains with Villa Alliopi.
§ 6 Pets
The accommodation of pets of any kind is not allowed in the villa.
§ 7 Stay
The holiday flat may only be used by the persons listed in the booking. Should the flat be used by more persons than agreed upon, a separate fee of 50 Euro per person has to be paid. In this case Villa Alliopi has the right to terminate the contract without notice. Subletting and transfer of the villa to third parties is not permitted. The guest agrees to the general terms and conditions as well as the house rules of the villa. The declaration of consent is made with the payment. In case of violation of the general terms and conditions or the house rules Villa Alliopi is entitled to terminate the tenancy immediately and without notice. A legal claim for repayment of the rent or compensation does not exist.
§ 8 Cancellation
You will receive a full refund for cancellations made up to 30 days prior to check-in. Guests booked less than 30 days prior to check-in date will receive a full refund for cancellations made within 48 hours of booking and at least 14 days prior to check-in date. Thereafter, a 50% refund will be issued up to 7 days prior to check-in. After that, no refund will be issued. In case of cancellation, the tenant may nominate a substitute tenant who is willing to enter into the existing contractual relationship in his/her place. A processing fee of 50.00 euros may be charged for this. Cancellation fees will not be charged in this case.
§ 9 Cancellation by the landlord
In the event of cancellation on our part, as a result of force majeure or other unforeseeable circumstances (such as accident or illness on the part of the hosts) as well as other circumstances for which we are not responsible making fulfilment impossible; liability is limited to reimbursement of the costs. In the event of justified withdrawal, the customer shall have no claim to compensation - no liability shall be assumed for travel and hotel costs. A withdrawal by Villa Alliopi can be made after the beginning of the rental period without adherence to a time limit.
§ 10 Liability of the landlord
Villa Alliopi is liable within the scope of due diligence for the proper provision of the rental object. Liability for possible failures or disturbances in water or electricity supply, as well as events and consequences due to force majeure are hereby excluded.
§ 11 Permission to use internet access via WIFI
Villa Alliopi maintains an internet access via WIFI in its villa. He allows the guest to share the use of the WIFI access to the internet for the duration of his stay in the holiday property. The guest does not have the right to allow third parties to use the WIFI. Villa Alliopi does not guarantee the actual availability, suitability or reliability of the internet access for any purpose. Villa Alliopi is entitled at any time to allow other co-users for the operation of the WIFI and to restrict or exclude the access of the Lessee completely, partially or temporarily, if the connection is or was used in an illegal manner, as far as Villa Alliopi has to fear a claim because of this and cannot prevent this with usual and reasonable effort in a reasonable time. Villa Alliopi particularly reserves the right to block access to certain pages or services via WIFI at any time and at its reasonable discretion (e.g. pages glorifying violence, pornographic pages or pages for which a fee is charged).
§ 11.1 Access data
The use of the WIFI shall be secured by means of access data. The access data (password) may not be passed on to third parties under any circumstances. If the guest wishes to grant third parties access to the Internet via the WIFI, this is subject to our prior written consent and the third party's acceptance of the provisions of this usage agreement, documented by signature and complete identification. The guest is obliged to keep his access data secret. Villa Alliopi has the right to change access codes at any time.
§ 11.2 Dangers of WIFI-Use, Limitation of Liability
The guest is informed that the WIFI only allows access to the internet, virus protection and firewall are not available. The data traffic established using the WIFI is not encrypted. The data can therefore possibly be viewed by third parties. Villa Alliopi expressly points out that there is a risk that malware (e.g. viruses, Trojans, worms, etc.) may get onto the end device when using the WIFI. The use of the WIFI is at the guest's own risk. We accept no liability for damage to the tenant's digital media caused by the use of the Internet access, unless the damage was caused by us and/or our vicarious agents intentionally or through gross negligence.
§ 12 House Rules, General Rights and Duties
(1) The guest is obliged to observe the house rules.
(2) Villla Alliopi has the right of access to the villa at any time, especially in case of imminent danger. The guest's interests worthy of protection are to be considered appropriately when exercising the right of access. We will inform the guest about the exercise of the right of access in advance, unless this is not reasonable or impossible for the guest according to the circumstances of the individual case.
§ 13 Jurisdiction
Any disputes arising from the contractual relationship shall be subject to the jurisdiction of the competent court in Greece.
